Silly Billy’s on the way out taking the ALP with him

from Robert J Lee in Brisbane

billy-gordon

Cook MP Billy Gordon

The controversial Member for Cook, Billy Gordon, dumped from the ALP after he revealed his historical criminal convictions, has retained his plum position after police dropped their investigations into sexting allegations made by two Far North women.

In October police issued a statement claiming there was insufficient evidence to lay charges against Mr Gordon, an Aborigine, for sending the women images of his penis.

Mr Gordon sent a text message of his penis to another Cairns woman, Christine Gibson, 50, who told him she would take it to the media unless he paid her $10,000.

Subsequently Mrs Gibson was charged by police for blackmail and made another appearance in the Cairns Magistrates Court yesterday for mention.

Cairns News received information claiming there had been political interference with the investigation into the two other women’s allegations, causing the cases to be dropped.

jo-anne-miller-MPDisgraced Police Minister Jo-Ann Miller last week  resigned from Cabinet after the Opposition accused her of “behaviour unbecoming of a Minister”, although no explicit mention was made of Mr Gordon’s sexting allegations.

The State Labor Government hangs tenuously on now independent Billy Gordon’s vote. Should Mr Gordon be charged with an offence that carries a sentence of more than one year’s jail, he will have to quit his position.

And gone will be the ALP government.

Treacherous Liberals sell Port of Darwin to Chinese

Australians won’t cop the sale of our country

6 November 2015:

Bob Katter Means Business

“Bob Katter means business”

KAP Leader and Member for Kennedy Bob Katter has responded angrily to comments by the Trade Minister on radio today that the TPP would encourage Asian investment in Northern Australia, saying the Australian public would not accept the sale of their country to foreign corporations.

“This Minister got clapped for his Free Trade deal by the Prime Minister – and the Prime Minister was thrown out on his head not long later.

“You should have got your message there, Mate.

“In Queensland, the biggest landslide in the State’s history occurred because the assets were sold by the ALP Government.

“Yet the LNP were so stupid that they went into the next election advocating the sale of our assets to big foreign corporations.

“What you call foreign investment, we Australians spit upon.

“Because we know what it actually is – it is reducing us to serfs working for foreign landlords.

“The LNP might work for foreign landlords, but the people don’t,” Mr Katter said.

Andrew Robb – Trade Minister

Mr Katter also slammed the Minister’s comments that to attract Asian investment water allocation was required – something that Australian farmers are desperately short of.

“This Minister is so brainless that he cannot see how idiotic that statement is.

“The LNP approach has been to give water rights to five or six big corporates, and everybody else gets nothing.

“If anyone thinks that the people of the North are going to stand idly by and see their water resources given away to foreign corporates, they’d better think again.

“We need to get out of our globalist corporate thinking and start looking after the people of Australia,” Mr Katter said.

Following the sale of the Port of Darwin to a Chinese corporation, Mr Katter will shortly be introducing legislation that will prevent assets of economic strategic importance or defensive importance being sold to foreign corporations.

At UN Summit, World Rulers Adopt Agenda for Global Socialism

A far-reaching United Nations plot to re-engineer civilization and impose global socialism on humanity, variously dubbed “Agenda 2030” and the “Sustainable Development Agenda,” was ushered in on Friday with a “thunderous standing ovation,” the UN Department of Public Information reported. Every one of the 193 UN member governments on the planet — from communist and Islamist dictatorships to those ruling what remains of the “Free World” — vowed to help impose the UN’s controversial goals on their subjects. Indeed, according to the UN and the global agreement itself, not a single human being will be allowed to escape what one prominent internationalist ominously referred to as the next “Great Leap Forward.”

That the UN Agenda 2030’s 17 so-called “Sustainable Development Goals” (SDGs) and its accompanying 169 targets are essentially a recipe for global socialism and corporatism is hardly open for dispute, as countless analysts have pointed out in recent weeks. Goal number 10, for example, calls on the UN, national governments, and every person on Earth to “reduce inequality within and among countries.” To do that, the agreement continues, will “only be possible if wealth is shared and income inequality is addressed.” The brutal communist dictatorship ruling mainland China even boasted of its “crucial role” in creating the UN agenda. But as the UN document makes clear, national socialism to “combat inequality” domestically is simply not enough — international socialism is needed to battle inequality even “among” countries.

In other words, Western taxpayers: Prepare to be fleeced so that your wealth can redistributed internationally. Of course, as has been the case for generations, most of the wealth extracted from the productive sector in what remains of the free world will be redistributed to the UN and Third World regimes — not the victims of those regimes, impoverished largely through domestic socialist policies imposed by the same corrupt regimes that will be propped up with more Western aid. More than a few governments and dictators also announced that they would be “aligning their national development plans with the Sustainable Development Agenda,” essentially ensuring a growing supply of poor people to exploit as a pretext for more UN-led global socialism.

The UN document, formally entitled “Transforming our World: the 2030 Agenda for Sustainable Development,” was adopted on Friday, September 25, at the start of the UN’s three-day Summit on Sustainable Development in New York. Speaking at the opening ceremony of the confab, UN Secretary-General Ban Ki-Moon hinted at just how far-reaching the plot really is. “The new agenda is a promise by leaders to all people everywhere,” he explained, presumably conflating “leaders” with mass-murdering gangsters such as Kim Jong Un, Raul Castro, and Robert Mugabe who somehow managed to seize control over entire nations. “It is a universal, integrated and transformative vision for a better world.”

As with all socialist and totalitarian schemes, the UN’s controversial agenda was marketed using vague, meaningless platitudes such as, for example, creating a “better” world, and “ending” poverty — common slogans among tyrants stretching back centuries. “It is an agenda for people, to end poverty in all its forms,” continued Ban. “It is an agenda for shared prosperity, peace and partnership [that] conveys the urgency of climate action [and] is rooted in gender equality and respect for the rights of all. Above all, it pledges to leave no one behind.” But the “true test of commitment to Agenda 2030,” he added, will be in its implementation. “We need action from everyone, everywhere,” Ban said, pointing to the “guide” offered by the 17 SDGs. “They are a to-do list for people and planet, and a blueprint for success.”

“Now,” Ban continued, “we must use the goals to transform the world.” “Institutions will have to become fit for a grand new purpose,” he said. “We must engage all actors, as we did in shaping the Agenda. We must include parliaments and local governments, and work with cities and rural areas. We must rally businesses and entrepreneurs. We must involve civil society in defining and implementing policies — and give it the space to hold us to account. We must listen to scientists and academia. We will need to embrace a data revolution. Most important, we must set to work — now.”

Whether the world’s adults can be persuaded to willingly join the UN’s bandwagon remains to be seen. But when it comes to children, the UN is taking no chances, devoting an entire “goal” in its agenda to ensuring that all children, everywhere, are transformed into what the UN calls “agents of change” ready to push forward the plan for the new global order. “Children and young women and men are critical agents of change and will find in the new Goals a platform to channel their infinite capacities for activism into the creation of a better world,” the UN goals explain.

The sort of activists that the UN hopes to make your children into is also explicitly defined in the unanimously adopted agreement. “By 2030, ensure that all learners acquire the knowledge and skills needed to promote sustainable development, including, among others, through education for sustainable development and sustainable lifestyles, human rights, gender equality, promotion of a culture of peace and non-violence, global citizenship and appreciation of cultural diversity and of culture’s contribution to sustainable development,” the global plan for 2030 states. Considering what the UN means by “sustainable development” — population control, central planning, global governance, and more — the agenda for your children takes on an even more sinister tone.

It all sounded so wonderful to some of the world’s most brutal dictators, though, that they could hardly contain their glee about the coming brave new world. “This agenda promises a brave new world [sic], a new world which we have to consciously construct, a new world that calls for the creation of a new global citizen,” gushed Marxist dictator Robert Mugabe, the genocidal mass-murderer enslaving Zimbabwe who also serves as chairman of the African Union. “I want to believe that we are up to this task that we have voluntarily and collectively committed ourselves to. Our success, and in particular the promise of a new world that awaits us, depends upon this commitment.” He also promised to vigorously impose the UN Agenda 2030 on the starving and impoverished victims his regime lords over.

The brutal tyrants ruling Communist China, meanwhile, have also been enthusiastic cheerleaders for the UN goals — goals that the regime boasted it played a “crucial role” in developing. Among other “commitments,” the dictatorship promised to spend $2 billion in foreign countries to meet the UN goals in “education” and “health,” with its funding increasing to $12 billion by 2030. While only contributing a small piece of the pie — the UN claims its agenda will cost somewhere between $3 trillion to $5 trillion per year — the fact that Beijing is so excited about the agenda is quite revealing. Echoing Chairman Mao’s rhetoric, EU and NATO globalist Javier Solana said that, “With a sustained commitment from all countries, developed and developing alike, the world can ensure that it celebrates another great leap forward in 2030.”

The Obama administration, which apparently does not plan to present the UN scheme to the U.S. Senate for ratification as required by the U.S. Constitution, also offered a forceful defense of the UN agenda. Speaking to the UN summit on Sunday after purporting to commit the United States to the global plot, Obama claimed the UN blueprint “is one of the smartest investments we can make in our own future.” He told the assembled dictators and government representatives that 800 million people live on less than $1.25 per day, without, of course, mentioning the reasons for so much poverty: Big Government policies that are remarkably similar in many ways to the UN’s new agenda. Obama, who has waged multiple unconstitutional wars, also claimed that “military interventions might have been avoided over the years” if governments had only taken better care of their hapless citizens.

Even the world’s leading religious figure, Pope Francis, addressed UN member governments with a plea to support the UN goals. “The adoption of the 2030 Agenda for Sustainable Development at the World Summit, which opens today, is an important sign of hope,” he said. It is worth noting, however, that not everybody within the Catholic Church hierarchy was quite as enthusiastic about the scheme. In their “Common Declaration of the Bishops of Africa and Madagascar” ahead of the UN summit, for example, Africa’s bishops blasted the “agents of the civilization of death” and called for much of the scheming to stop. “We implore you to end the filthy campaigns that promote a civilization of death on our continent,” they said, slamming the “terrifying resurgence of a colonialist spirit under the guise of the appealing names of liberty, equality, rights, autonomy, democratization and development.”

Beyond governments and religious figures, much of the private sector also enthusiastically backed the new goals. Among the mega-corporations backing the scheme are the world’s top three search engines: Google, Microsoft’s Bing, and Yahoo. It was not immediately clear whether those corporations’ support for the UN agenda would affect the supposed impartiality of search results, but critics of the UN plan expressed alarm nonetheless. As The New American reported in May, meanwhile, top media outlets around the world are also participating in a massive propaganda campaign to support the UN agenda.

Of course, Obama has no constitutional or statutory authority to commit the American people to the UN’s radical blueprint for humanity. But unless the GOP majority in Congress is willing to stop funding the administration’s antics, there can be no doubt that the White House will charge ahead using its pen, phone, and taxpayer funding provided by Republican members of Congress. Lawmakers who are serious about their oath of office must work to restrain the Obama administration, and ultimately withdraw the U.S. government’s membership from the UN. Faced with a totalitarian UN agenda for global socialism under the guise of “sustainable development,” now would be an excellent time to get busy.

The treachery of the LNP/ALP nexus – Lima treaty winds down manufacturing and production by 30%

THE LIMA DECLARATION AN OVERVIEW

  •  How does it effect you and your family?
  •  What is the Lima declaration?

The correct title is:-  Lima Declaration and plan of Action on Industrial Development and Co-operation

agenda21logoIt is an international trade agreement similar to G.A.T.T, (General Agreement on Trade and Tariffs), Australia is a signatory to The Lima Declaration as it is to many GATT agreements.

Australia signed The Lima Agreement with the total support of all major political parties and no consultation with we the people.

It should be clearly understood that the ‘Lima Declaration’ is one of many hundreds of international agreements and treaties signed by Australian Public Servants, usually by The Minister for Foreign Affairs or nominee, who signs on behalf of all Australians.

It should also be clearly understood that 99,9.% of Australians do not know what such agreements and treaties are about, nor how they effect their lives, and they are not told, if they were, there would be instant riot.

International treaties in the main are the handy work of the United Nations and have been used by Australian Governments to undermine Australian Sovereignty.  The High Court decision on the Franklin Dam issue in Tasmania is a case in point.  Used to put in place processes the impact of which the Australian ~op l e are completely unaware, and if they were aware, would be totally opposed to, processes that “get- around”  “The Australian Commonwealth Constitution.”  In other words, treason.  And treason is being committed in the name of International Treaty, or the other names given to them, such as conventions, or in this case declaration, The Lima Declaration.

You may say treason is a strong word, but after reading this brief you will say it is not strong enough, without doubt sufficient reason to impeach the Australian Government and opposition on charges of Treason.

A copy of The Lima Declaration may be obtained from the United Nations in your Capital City, or the department of Foreign Affairs in Canberra, by phoning the treaties support unit on (06) 261 3590 .

While you are on the phone ask them how many treaties, declarations, conventions, etc exist.  Ask for copies.  Ask for the complete set.

You may say treason is a strong word, but after reading this brief you will say it is not strong enough, without doubt sufficient reason to impeach the Australian Government and opposition on charges of treason.

One Pissed Off Aussie Infidel

refugee-nowar-zone

It’s not asylum seeking when they travel through several safe countries to get to AUSTRALIA. It’s money seeking.

If they were genuine refugees fleeing persecution and not a threat to our children I would be the first one to put my hand up to assist them. But most of are coming from extremely violent countries where violence is all they know.

Most of them belong to a barbaric anti western, anti women, anti disbelievers, ideology from the Stone Age.

These people have already proven themselves to be detrimental to every country they infest. Social upheaval, soaring crime rates is always a result.

How can we import the exact same people and expect a different outcome?

This will only end in tears.

Australian Parliament to comply with UN World Government 17 Goals September 25-27

MENU for Official Documents September 25-27 Agenda

tony-abbott-1

Prime Minister Tony Abbott

If you are surprised that your parliament is handing over Australia to the United Nations “Agenda21” that will introduce a world government, then you need to be brought up to speed.

Did you know that the UN is planning to launch a “new universal agenda” for humanity in September 2015? That phrase does not come from me – it is actually right in the very first paragraph of the official document that every UN member nation will formally approve at a conference later this month. The entire planet is going to be committing to work toward 17 sustainable development goals and 169 specific sustainable development targets, and yet there has been almost a total media blackout about this here in the United States. The UN document promises that this plan will “transform our world for the better by 2030“, and yet very few Australians have even heard of the 2030 Agenda at this point. Instead, most of us seem to be totally obsessed with the latest celebrity gossip or the latest nasty insults that our puppet politicians have been throwing around at one another. When will people finally start waking up?

Both Liberal and Labor parties are totally compliant with “Agenda21” and have it as a hidden agenda since 1990, keeping you out of the loop.

The United Nations is the worlds most proven inefficient organisation, a facade working for international corporations and bankers to launder themselves as humanitarian while harvesting massive funding and power-base footing ready for Agenda21 opening the flood gate to dominate under one government they already preside over.

We have compiled some information for you with the current ““Agenda21” foot holding that will make George Orwell’s 1984 fiction novel become reality.

gears-moving

From the official UN document these quotes are disturbing:

You need to be concerned

We, the Heads of State and Government and High Representatives, meeting at the United Nations Headquarters in New York from 25-27 September 2015 as the Organization celebrates its seventieth anniversary, have decided today on new global Sustainable Development Goals.

Now you really need to be VERY concerned

On behalf of the peoples we serve, we have adopted a historic decision on a comprehensive, far-reaching and people-centred set of universal and transformative Goals and targets. We commit ourselves to working tirelessly for the full implementation of this Agenda by 2030. We recognize that eradicating poverty in all its forms and dimensions, including extreme poverty, is the greatest global challenge and an indispensable requirement for sustainable development. We are committed to achieving sustainable development in its three dimensions – economic, social and environmental – in a balanced and integrated manner. We will also build upon the achievements of the Millennium Development Goals and seek to address their unfinished business.

This is nothing less than a global government takeover of every nation across the planet. The “goals” of this document are nothing more than code words for a corporate-government fascist agenda that will imprison humanity in a devastating cycle of poverty while enriching the world’s most powerful globalist corporations like Monsanto and DuPont for starters.

“Australia is deeply committed to accelerating progress towards achievement of the MDGs and the ongoing discussions on the post-2015 agenda” – Attributed to Australian United Nations Security Council – http://australia-unsc.gov.au/australia-and-the-un/ .

Now the future of Australia and future generations are to be handed to the United Nations … DO SOMETHING … TODAY ! ! ”

Debt Summit calls for government moratorium on bank foreclosures

A meeting of more than 300 cattle producers at Charters Towers has called on the federal government to create the Australian Reconstruction and Development Board and place a moratorium on bank foreclosures before the state’s cattle industry completely collapsed.

Called by the Member for Dalrymple, Shane Knuth, the crisis meeting followed on from a similar meeting held by the Member for Mt Isa, Robbie Katter at Winton last year.

Producers demanded the federal and state governments act immediately to introduce the ARDB, modelled on the Rural Reconstruction Board of 30 years ago which was designed to absorb the “toxic” trading bank interest debt that has engulfed primary industries and to issue low interest development funds for primary producers and small business.

More than 20 resolutions were passed unanimously by the gathering of desperate and often distraught cattle producers.

While an unprecedented 80 per cent of the state is reeling under a drought declaration, producers heard how social media and 60 Minutes superstar Charlie Phillott, 81, of Winton, beat the ANZ Bank and had his property returned with a substantial settlement.

Mr Phillott’s plight has been closely monitored by the 60 Minutes television show and scored an Australian record 3.5 million hits on Toowoomba veterinarian David Pascoe’s social media site.

He urged producers to stick together when fighting questionable behaviour by the banks.

He said he had never missed a repayment but when the bank restructured his loan he was unable to manage and was eventually put off his Winton property after the bank took it over.

“All of us here owe a great deal of gratitude to Bob Katter for he saw my position and stood by me for two years ,” Mr Phillott said.

Primary Industries Minister Bill Byrne when addressing the meeting started an uproar when he said the State Government would not be building more dams because there was “no business return” from farming.

Charters Towers cattleman Mick Pemble attacked the Minister asking why he could not build dams, and “…do what everybody else in this room does and borrow the bloody money!”

“If I could make it rain I would, but our resources are finite and we are working on what can be done in the circumstances,” Mr Byrne said.

“There are amendments before Parliament and our policy is that water is critical to agriculture but the government capacity to fund such a project is limited.

“If you build dams in the city or for mining you get capital back but for agriculture you do not get capital back.

He said federal money or private investment would be needed to build dams.

Meeting chairman Shane Knuth said he was aware of highly questionable behaviour by bank-appointed receivers that had caused a lot of grief to families through no fault of their own.

He said there were many hundreds of northern producers in financial difficulties and the local industry could collapse unless the bank debt issue was resolved.

“I know some of you want to speak, and I am aware that confidentiality agreements stop you from telling us about what the receivers have done to you, but everyone is behind you and we must stop the foreclosures,” Mr Knuth said.

Burdekin farmer Max Menzell asked the Minister why police were involved when foreclosures took place adding that they should not be used by the banks and receivers as debt collectors because foreclosures were a civil matter.

The Minister strongly defended the use of police stating categorically: “That is the law.”

Mr Knuth said more meetings and what actions should be taken would be called unless the government brought the banks into line and stopped foreclosures immediately.

Member for Kennedy Bob Katter, Charlie Phillott, Member for Dalrymple Shane Knuth and Member for Mt Isa Robbie Katter.

Mr Phillott said the northern grazing industry and businesses owed Bob Katter a great deal of gratitude for giving producers a voice in dealing with banks and foreclosures.

BUST THE BANKS

We will face the crisis with aggression and unity – KAP

Charters Towers Debt Summit August 31, 2015

With less than a week until the Charters Towers Rural Crisis Summit, Member for Dalrymple Shane Knuth said he has felt a groundswell of interest.

” Since we announced that a summit would be taking place I have been fielding calls from graziers and small business owners in drought effected areas all over the state,” Mr Knuth said

“The amount of people who are getting involved in this is encouraging, the rural crisis really is the issue of our time.

shane-knuthMr Knuth who will be chairman on the day with KAP member for Mount Isa Rob Katter said while the speakers at the summit will help bring context, it is a priority locals are given the opportunity to speak.

“The summit is important but the action that follows after is essential,” Mr Knuth said.

“The resolutions devised and agreed upon at the summit will form a blue print for action in rural Queensland.”

Member for Mt Isa Rob Katter who held a similar summit in Winton last year said the rural crisis committee which has since become the backbone for rural advocacy in the area.

“Less than a year on the committee has been instrumental in applying strong pressures to the government in face to face meetings, but we aren’t done yet,” Mr Katter said.

“There needs to be a stronger and more direct connection with between the cattle producers, business owners and the policy makers, we are trying to facilitate this.”

KAP Federal member for Kennedy Bob Katter who will also be part of the day has widely encouraged people from all walks of life to join to help find a solution.

Mr Katter said the current high price of cattle due to the lack of stock available isn’t a consolation for struggling farmers because they themselves have no cattle to sell.

“There are answers here, and we have got to go to those answers with aggression and unity,” he said.

“Wandering around blaming political parties quite frankly isn’t going to get us anywhere, there is a big system of power there and we must assail it on the political front, the economic front and through social media.”

Mr Katter drew reference to the story of Charlie Phillott (speaking at the summit) who’s story written by David Pascoe, went viral and became the most shared post in Australian History.

“The people of Australia are  behind us, but we have got to know clearly what we want,” Mr Katter said.

“We must fight for survival.”

Editorial: Australia down under is about to remain down under

Cairns News can confirm there are people in Australia who intend to vote for Labor. As hard as it is to believe, these people have as much intelligence as an Islamic goat rider. This is not to say the Liberals are much better, but with Dick Smith emerging soon to lead a new political force there is hope for this country. Unless the two-party nexus is broken up we will be doomed forever to financial slavery, corporate government, union corruption, government corruption and more and harder police-state controls. Wakey wakey ALP and Liberal voters – your time is here!

State Government’s irrigation proposal is just corporate farming, says Katter

22 August 2015: KAP Leader and Federal Member for Kennedy Bob Katter today warned the Queensland Government that the Gulf and Mid-West would not stand by and allow its water resources to be allocated to corporate farming.

image0011

Bob Katter MP

The Queensland Government today released an amended Gulf Water Resource Plan, which includes a competitive tender process for general unallocated water reserves from the Flinders and Gilbert River. However, the Gilbert River catchment reserves will not be made available until after the environmental impact assessment process has been completed for the proposed Integrated Food and Energy Developments (IFED).

Mr Katter said today that the plan would amount to nothing more than corporate farming, which was of no value to the people of Australia.

“Whilst we welcome the Minister’s positive comments on water development, there is no way in the world we’re going to stand aside and see all of our water given to corporations.

“Because that is what is proposed here. Between IFED and talk of tendering, there is no doubt that all we’re talking about is corporate farming, which is worth nothing to our communities nor the people of Australia.

“Scams galore, in the way of the Cubbie Station type now owned by the Chinese, are the way of the future. The only prominent names in the current IFED proposal were both involved with Cubbie Station when it was sold.

“If anyone thinks that the people of the Gulf and Mid-West are going to stand idly by and see their water resources given away to the major corporates, they’d better think again.

“We need to get out of our corporate thinking and start looking after the people of Australia, instead of the globalist corporate models.

“The Minister I think will do the right thing, but he has to understand that to date the corporate and environmentalist cart has been put in front of the interests of the people that live in the Gulf.

“The only proposals that currently exist outside of the Upper Burdekin Irrigation Scheme (UBurIS) are corporate proposals, and they will yield no benefit to the local communities whatsoever.

“We are in the process of negotiations with the State members representing these areas and we are determined that the interests of Australians living in these areas will be paramount.

“The benefits of irrigation should flow to everyone that lives in these areas, the townies, the contractors, the workers, the cattlemen and it seems to me the three corporate proposals deliver no benefit to any of those people,” Mr Katter said.

Government Bank Inquiry calling for Public Submissions

In case you were not aware the government House of Representatives on June 4th 2015, referred the terms of reference listed below, relating to the impairment of customer loans, to the Parliamentary Joint Committee on Corporations and Financial Services for inquiry and report by 31 March 2016.

sherlockWhat this means is that practices of banks and other financial institutions using a constructive default (security revaluation) process to impair loans by devaluing property held as security increasing the loan to equity ratio to suit their underhanded foreclosure agenda.

Be aware of previously conducted Parliamentary Inquiries that with considerable taxpayer funding did not halt the standover merchants of finance. Take time to read terms of reference and conclusions to get the picture how thick the whitewash was applied.

The committee is looking for submissions from the public and the closing date is 21st August 2015.

I would suggest that everyone read submissions already presented with all farmers reading the 3rd submission put forward by Mr Richard B. Wright and Mrs Barbara Ann Wright. It’s all about ANZ destroying a very successful cattle farming business where bank receivers – sent cattle from a registered stud for slaughter – sent registered horses from a stud to be sold at dogger prices, and much more. [Click Here].

It is important for home owners, business owners and farmers, who have had a lender manufacture a default, to make a submission. However, pay particular attention to the terms of reference listed below, keeping your submission relevant to those terms or your efforts will be deemed not relevant.

Terms of Reference:

  1. practices of banks and other financial institutions using a constructive default (security revaluation) process to impair loans, whereconstructive default/security revaluation means the engineering or the creation of an event of default whereby a financial institution deliberately reduces,through valuation, the value of securities held by that institution, thereby raising the loan-to-value ratio resulting in the loan being impaired;
  2. role of property valuers in any constructive default (security revaluation) process;
  3. practices of banks and other financial institutions in Australia using non-monetary conditions of default to impair the loans of their customers,and the use of punitive clauses such as suspension clauses and offset clauses by these institutions;
  4. role of insolvency practitioners as part of this process;
  5. implications of relevant recommendations of the Financial System Inquiry, particularly recommendations 34 and 36 relating to non-monetaryconditions of default and the external administration regime respectively;
  6. extent to which borrowers are given an opportunity to rectify any genuine default event and the time period typically provided for them to doso;
