Errant police drop charges against Walter in Cairns Magistrates Court

Vexatious assault charges against David Walter by two Cairns court protective officers were dropped today at a trial in the Cairns Magistrates Court.
On the second day of the hearing, Chief Magistrate Ray Rinaudo allowed the police prosecutor to discontinue.
After eight witnesses for the defence gave their evidence that Walter did not assault the police officers, the prosecutor dropped the charges, which if found guilty, could have seen Walter jailed for a considerable time.
Vexatious charges against David Walter were dropped in the Cairns Magistrates Court after eight defence wirtnesses gave evidence that Walter did not assault court officers.
The moral of this story is that the bull-headed police, as most journalists know, form the thick blue line, and the prosecutor and the DPP are not afraid of spending more than $40,000 of Cairns Police District’s scant taxpayer operational funds to pursue a knowingly vexatious charge against a former senior police officer with 37 years unblemished service.

That on the 22nd day of May 2017 at Cairns City in the State of Queensland one David John Walter unlawfully assaulted Mark Francis Webb a public officer whilst Mark Francis Webb was performing a function of his office and it is further alleged that the assault by the said David John Walter caused bodily harm to the said public official.

Criminal Code (CC) – [CC] 340(1)(a) Serious assault with intent to commit crime or resist arrest.
That on the 22nd day of May 2017 at Cairns City in the State of Queensland one David John Walter assaulted Matthew David Trezise with intent to prevent the lawful arrest of the said David John Walter.

Witnesses said Walter was able to get his entire argument about the court having no authority into the record in spite of the protestations of the prosecutor.
This has been a great day for the vague semblance of justice left in the corporate court system, run by judicial officers who are inside the corporation and lawfully, can only preside over civil matters to do with members of political parties.
Former Labor Premier Peter Beattie’s removal of the Crown in 2001 from the State of Queensland is now coming back to bite him.
These comments have been made by Romley Stewart who attended the court today:
“I know all about the brutality of the Queensland Police and the Government, its a shame because believe it or not, it was the honest Police that told the truth on the stand and could not back up the lies of the one that lied under oath.
I called into the Court today and made a verbal complaint against the officer that lied under oath, the hearing was still going I think, the lying officer was the one that punched me in the back while I was in the watch house, I made a complaint to Sargent Dwan (Nice man) of the Cairns police and he asked me to please keep it internal, which I did and after seeing the same man lying under oath in David’s case, I went and made the complaint that I should have stuck to my guns and made the complaint formal in the first place… Both magistrate Bentley and the Lying Officer should be removed from Queensland Police and the Court…
David raised some very concerning points about the conduct of Queensland Police and Queensland Government while in Court, and even the Magistrate, as good as he was, seemed concerned about the research done by David in relation to the validity of governments since Whitlam signed the UNIDROIT treaty of Rome in 1973 and in relation to the registration of Australian governments being registered to the US SECURITIES AND EXCHANGE COMMISSION, being a foreign banking system.
In relation to the Magistrate Rinaudo, and Magistrates like Magistrate Comens, as corrupt as the system may be, such man do consider and are interested in knowing the truth before making judgement within their Star chamber courts. Well done David, and thanks to Magistrate Rinaudo, for his conduct as well… He respected David from the beginning and gave David plenty of scope in order to get the truth out of this matter…”

I think it to early to discount the impact of even a little win. In this system that we endure any win is a move forward. There has never been a record of this kind entered into the Court and as I said previous the transcripts will reveal what was actually said. In regard to whether they will continue to offend, I think that it will be business as usual. The cats out of the bag, however there are a lot of ill informed or those that care not and whilst that is the case we will get a referendum at the earliest and shift to a republic so that they can put the sins of the past behind them.
Something that no-one has mentioned is when will the DPP file charges against the Police Officer for perjury, a criminal offense?

Ed, it was obvious that the whole process (the bankruptcy matter, loosing his wife, now these charges) has upset David considerably. But he didn’t seem to be all over the place during Court. As I said, I was also there for the entirely of the two days. And the outcome you have reported is not the outcome that occurred.
I only became aware of David this year, and am not familiar with any of your articles that directly quite him. All I was saying was that David asked the prosecutor specifically about your website after one of David’s witnesses referred to it Monday afternoon, and the prosecutor asked another witness about it Tuesday morning. I saw the prosecutor show David some articles about him, and David was very upset, and said he didn’t know anything about your website. See my comment to Graeme below for more on this.

Not to me directly. He was speaking with the prosecutor at lunch, then again after Court Tuesday afternoon. Wayne STARR (who gave evidence on Monday) was also there Tuesday afternoon.
David was saying that he didn’t know about this website, or about Harry Palmer’s podcasts (sosnews.org). The prosecutor showed him some of the articles, and David was saying things like “why can’t they mind their own business” and asking how this site got photographs of him. He asked who had access to the website, and seemed concerned when the prosecutor told him anyone could access it. As I was leaving David was talking with the prosecutor and Wayne STARR about how to get in contact with the editors and get his photographs taken down.

He already has but the Court run by Corporate Agents of the State have refused to hear him. They side with the Lawyers every time.
I was witness in Brisbane to how our Courts are now run. What I witnessed was what I believe to be a Military tribunal!
Perhaps we should focus on the positives rather than create descent from overheard conversations.

They [Government] are threatened by sheep that stray from the flock.
The Constitution [Annotated 1043 page version] the one that they removed from our Libraries in the early 1990’s are our [Peoples] rules imposed on Governments. Not to be confused with the “dodgy bros version” corporate version. This full version has been kept from us and revelations pursuant to the application of section 44 are now taking there toll.
Section 44 forms part of our rules on Government and it is heartening to see these rules now being applied [Culleton]. David has been trying for years and finally he is being listened to.
Reminded of the quote attributed to Mahatma Gandhi “First they ignore you, then they laugh at you, then they fight you, then you win”.
My hat of to the Chief Magistrate for allowing material evidence to be entered into the record, this is how it is supposed to work. Now it remains to be seen if this then translates to orders being imposed on the Commissioner and Police to comply with the Law.
It now falls to the Federal Police to do their job and start investigations and prosecute the Law on all law breakers of our Constitution. It is their duty to uphold the Law of the Land.
Make no mistake they will be watching the outcome of this and Rodney Culleton’s Court actions and if they are not I would be astounded.
We have been given a “gift” [Court on 30th-31st in Cairns] lets not stuff it up with infighting this is their greatest asset [divide and rule].

This is not much of a ‘win’.
The courts continue their malpractice and their misprision of treason without wavering from their participation in the ‘slavery-by-deceit’ system we are all under.
Basic corruption of the very principles of law will continue to permeate the entire system until it is burnt to the ground and started over.
I have had magistrates literally state in court that I was ‘guilty until proven innocent’ and demand I ‘prove a negative’ that the Proclamation for the legislation did NOT exist, rather than the prosecution prove that it did! Anyone trained in even law basics know it is impossible to prove a negative, yet this was stated IN COURT from a ‘learned magistrate’!!!

Hi there Sven the information came from a member of the gallery who was present throughout the entire case. If you have been watching Cairns News for the past five years you will find most of David Walter’s court cases and arguments that have been published with direct quotes from him. David unfortunately is all over the place and that is understandable considering the pressure he has been under, since losing his wife and property.Ed

I hope David Walter will now prosecute every single crime committed against him and claim millions in compensation for being illegally tortured by imprisonment. Every scum involved deserves the death penalty for being treasonous traitors.

I’m confused. I came and watched the full two days of the trial. On Tuesday afternoon Magistrate Rinaudo told David that his understanding of the law was incorrect, and found David guilty of both charges. When the prosecutor was asked to make submission on sentence, he indicated that there should be no further punishment in light of the punishment David received in May for the contempt, and the magistrate agreed. I don’t know where you get the information that the charges were dismissed.
Also, I overheard David talking with the prosecutor at the lunch break and again after Court – David had never heard of your website, and he was quite angry that you have published photographs of him without his permission.

It’s great that more people are standing up to these courts of no lawful jurisdiction. It is time for these money grabbing corporations (aka mag courts) to close their doors. Good on you David.

David Walter is a good man! and he went very well in the Court!… I only saw the first half of the first day but even after the first few hours and seeing one Police officer in particular, I was disgusted with the lowest of low standards of Queensland Police and the length they will go in order to maintain an injustice.
David’s only concern is for the children and grand children of Queensland and Australia being subjected to such a disgraceful foreign corporate government such as what we have now. David’s moral stand was what won the day and the magistrate Bentley, that put David in prison for a month for contempt should be dismissed. She is a disgrace and no better than the lying police that sat under oath and lied his guts out in order to cause an injustice.
