An application to the Federal Court in March by Dr Julian Fidge alleging Pfizer’s Covid 19 vaccines contain genetically modified organisms and therefore should be licenced under the Gene Technology Act was dismissed by Judge Helen Rofe.

While we agree with the general tenor of the Julian’s assertions, many lawyers are fixated in their own ideologies & not necessarily for the benefit of their client! Then judge must be provided with a solid basis from which to make her decision against a respondent.
Having read the decision, it seems that once again, the lawyers have gone in 3/4 cocked and let the side down with their ideologies. The GMO argument is skating on thin ice.
A better approach would be to tackle the lack of isolation of the virus and legal lack of definition of COVID-19 and the alleged virus. Additionally, basic virology textbooks warn of the dangers of using DNA/RNA technology without first using rigorous testing to determine whether DNA damage is possible.
As far as standing goes, the doctor has personal standing in that the jabs are able to be shed and therefore a danger to him and professionally, his profession is meant to take care of patients and not to administer harmful substances negligently.

In the Appendix, the correct descriptor ‘covid-19’ appears 18 times. Given ‘COronaVIrus Disease’ has been a thing for at least 40 years why didn’t they use the term ‘Covid-19’ in the main body of the letter? It looks like a way to dodge liability?

The case I ran in the above article should be the template of how to run another case. Essentially, WHAT IS THE RATIONAL BASIS for the decision/s,
The case should be run so as to get the judiciary to confront the Parliamentary Sovereignty issue. First, the pleadings should indicate that the decisions were void as there was no ‘rational basis’ for their decision. This is based upon the fundamental principles of English Law.
By basing the case on the fundamental principles of English Law the issue becomes two tiered. First, the question of ‘do the fundamental principles of English Law still apply in Australia?’
Once the court deals with that question of law, yes, the fundamental principles of English Law still apply and one of those principles is that a law must have a reason for its existence (the mischief the legislation was designed to remedy). Then the higher court can remand the matter to a lower court to take evidence as whether there is evidence to support that rational basis.
By doing it as a two-tiered court case, the judges will be free from the sophistry they enjoy using and make it solely on a point of law (as mentioned in my article). They will not be placed in a position of actually directly adjudicating on the actual decisions of the government, it will only be on a BIG point of law.
