Property repossessions by banks could be unlawful in numerous cases leaving banks and insurance companies liable for massive compensation

Farmers and landowners who have returned to their seized land could be entitled to windfall compensation after police forcibly removed them from their farms at the behest of banks.

If the title deeds are in the name of dispossessed owners then due process has not been followed by sheriffs seizing land under police protection leaving state governments and insurance companies who insured the loans under threat of huge compensation payouts.

Many of the affected titles involve farming families who were removed from their land by police, despite being the lawful owners named on the title at the time.

“In retrospect, the removals were unlawful, and those farmers now have a right to return, and two owners have already done so, one in WA and one in Victoria,” West Australian senate candidate and former Senator Rod Culleton told Cairns News.

“The rule of law must prevail — no landholder should lose their home due to procedural misconduct.”

Culleton has issued a second formal notice to the Western Australian Registrar of Titles, demanding immediate correction of fraudulent entries on eight land titles unlawfully transferred without compliance to the Civil Judgments Enforcement Act 2004 (WA).

Despite uncontested evidence being submitted to the Commissioner of Titles in February2024, no action has been taken to correct the register under section 188(3) of the Transfer of Land Act 1893 (WA), which requires the Commissioner to amend the register when fraud or error is apparent.

Culleton now believes the Commissioner of Titles is acting outside the boundaries of legislation and may be complicit in enabling the fraud by failing to exercise their statutory obligations to protect the integrity of the land titles register..

“The refusal to act on uncontested evidence of fraud is not just an administrative failure — it places the State in breach of its own laws and could result in substantial liability to State and Treasury,” said Mr Culleton.

Under section 246 of the Transfer of Land Act, compensation may be payable to anyone who suffers loss due to errors, omissions, or fraud on the register — liabilities that fall directly onto public funds.

The failure to act also raises significant concerns about potential breaches of:

  • The Model Litigant Principles,
  • Administrative law standards, and
  • The fundamental duty of public officers to uphold the law.

“This matter is not only a private injustice but a public risk — to the financial integrity of the State, confidence in the land title system, and the rule of law.” Mr Culleton said.

“I have briefed Victoria Senator Ralph Babet and Queensland MHR Bob Katter who are keen to get some remedies for the many land owners dispossessed of their land by banks which have used a similar corrupted process.”

Rod Culleton is a senate candidate for the Great Australian Party in WA and has a prominent candidate, Dr William Bay, running in the Queeensland senate election.

    And here’s the crux of the matter, folks, these bastards can do whatever the Hell they want, which is exactly what they DO, because there’s no accountability AT ALL. Since when is a rat’s nest of CORPORATIONS going to penalise ITSELF?

    So long as no-one has the balls to face them down and call them out, they pocket the loot and laugh all the way to the F*CKING BLOOD-SUCKING BANKS, but if their crooked schemes go wheels up, in any DECENT country they’d all be swinging by their greedy scrawny necks, but here in Australia THE PUBLIC PAYS for their crimes, not them.     OF COURSE the paid-off “politicians” and public officials and unelected beauracrats are all COMPLICT, folks, in it up to their NECKS with the crooked BANKS and the armies of shit-for-brains hired mercenary thugs masquerading as “police”, because they’re ALL COMMERCIAL COMPANIES, they’re all CORPORATIONS, and who do suppose owns the SHARES in those corporations, folks?

    And in case anyone hasn’t noticed, there’s an awful lot of licking going on in the Land Down Under, hijacked lock stock and barrel by FOREIGN CORPORATIONS.

  4. As the value of money goes to zero the price of gold goes to infinity.
    So if you sold some land the bank creates some credit and gives you that credit on behalf of the owner, and you are credited with the amount. Then the bank gets a mortgage over the actual property while the buyer gets “debt” and the seller gets “credit”. The seller would do much better to immediately convert the credit to gold, the price of which might double in a year or three, while the value of the money might halve in the same time.

    Culleton has been making a good effort for the farmers but whatever his advertising is, it hasn’t reached me and I am in WA.

  5. More Police tyranny…Freemason story. (It has to be!)

    My father is Vietnam Vet, Freemason too, he liked a drink at the RSL on a Friday night at the time after dinner with mum and often one of the three grandsons with them usually too.

    My nephew asked me later, why did Pa drink four pots in row before we left? ‘Not sure mate’…I’m on crutches, still recovering from crushing/reconstruction of my heel (Sept 2012)…’other than your Pa was definitely coming home to fight me!’. Dad has a habit of needing a few ‘cans of courage’. He hasn’t beaten me once since I was 14 despite his absurd trying, he starts them all too. He was having a go just over a month ago, trying to physically intimidate me, he is bloody 81 now the bully!

    Dad had obviously decided I needed to be kicked out, I was living with them in their 5 bedroom house, upstairs, to save to buy a house, now that was not going to happen since my accident. I told him to ‘bugger off and go to bed ya drunk!’.

    I’d just paid Mum my board that day and he has to give me a months notice at least. Not pick 11pm on Friday night to just violently throw me out of the house in his drunken stupidity without any notice, I hadn’t done anything wrong, there was no talking whatsoever to me about it before hand, not even a hint. This is the crap I had to deal with since a teenager.

    So I walked up the stairs and the madman came after me, he hates being ignored like that. He grabs my arm just as I got to the top of the stairs and tries to pull me down the stairs…I am on crutches, my foot is stuffed, I can’t walk too far at all without them! So I am standing on one foot basically, I walk around the house without the crutches, so I couldn’t hit him with them! That would be fair, believe me.

    Imagine a water skier behind a boat, leaning back holding the rope with two hands, that is my Dad trying to pull me down the stairs! I had hold of the balustrade, literally ramming it into the wall, it was always loose and dangerous, not attached to the ceiling joists, you couldn’t lean on it, it would have collapsed and you would end up downstairs in the loungeroom.

    I told my Dad, ‘hold the stair railing Dad, or you going down the stairs on your own, I’m not going down with you like this, I have a right to defend myself.’ I told him a couple more times to hold the stair railing, to let me go…then pushed him with the other hand and pulled the one he had hold of. Dad went down the stairs, all the way to the bottom. My Mum and my nephew were watching, listening to all of this. It was self defense, he was better off going down alone than with me falling on top of him too.

    I went in my bedroom, jammed the door shut so he couldn’t get in without kicking it in, I made a huge mistake next, I RANG THE POLICE TO PROTECT ME! I thought they would lock him up for drunk and disorderly…I still can’t believe what happened next. It makes no sense…but Freemasonry.

    The male cop asked me what happened. I told him the truth. My nephew came in after that and asked about his Pa drinking his four pots of courage…here comes the terrible moment from me. I let my father know in no uncertain terms that I knew his attack on me was pre-meditated. He was planning on it at the RSL, but the four pots he drank in a row, as if he is Bob Hawke, got him horribly drunk. There was lots of swearing no doubt. That was the problem.

    The male cop came back, strangely asked me if I was a Freemason, that didn’t make much sense, ‘No way, it is a bunch of weirdo’s doing a bunch of weird shit!’. I still feel the same today if you must know.

    Dad would never tell me anything at all about Freemasonry, I had to join or know nothing. I did not join and I do not know nothing anymore, I know things he doesn’t, I could tell by talking to him last month. The cop started moving stuff, like a pair of scissors, anything that could be used as a weapon, I was suspicious about that, he was making out I might become a threat and it made no sense at all. I had called them to stop my Father from giving any more violence to me in his drunken state.

    I was ‘detained’ he said, not ‘arrested’, ‘detained’. No hand cuffs, no jacket, I had no idea what was going on. My nephew ‘paid out on them’ with all the swear words he could think of and invent, he knew exactly why they were taking me, I had swore in front of my clearly foul mouthed nephew! He started with ‘I don’t give a fuck if my uncle swears in front of me, my Pa attacked him!..and whatever else, I told him to stop it mate and he bawled his eyes out, his Mum, my youngest sister, just arrived at the same time the cops were taking me away, my sister took him home, not away from me, but my father.

    They stole my renters rights away from me. I wasn’t given any notice, I had very little money being on sickness benefits due to my foot, I now had an INTERVENTION ORDER!!! 2 months jail hanging over my head, with my Dad being the one swinging the axe! My abuser now had the ultimate weapon of bullying!

    For swearing in front of my nephew. I was not even allowed to get a jacket, I got released at about 3am, they had even banned me from using my crutches in the Police station, they took them off me. I was suddenly homeless, I wasn’t allowed to go back to my parents house, I had very little money, I needed my rent money back, I couldn’t ring and ask for it back…

    Dad somehow communicated he needed their help, not to be locked up. I think it got a bit out of control on him, as he wanted me gone that night, so they did it, fool bragged he was 31st level last month…but an intervention order? I asked Dad to get up at the court on the Monday and ask the judge to remove it, he is far more reasonable when he isn’t drunk, he refused.

    So I got removed without notice, as if I was dangerous or something, though I had a severely injured foot and needing crutches, that I rang them for protection, I had been attacked and could have been hurt severely by his actions, I got an intervention order against me because of my father, yet, it was because I swore in front of my nephew?

    About 9 months later, I had been allowed to go to Mum and Dad’s almost near the beginning of the intervention order, I was actually going to stay the night. About 9pm Dad told me to ‘go to bed or go home’. I was over 40 years old then. I had been drinking, too much to drive, not enough to be drunk. I told him I hadn’t done anything, he could just close the bedroom door, I was just talking to my Mum. He threatened to ring the Police.

    So I risked drink driving to get away from the arsehole who just threatened to put me in jail. No crime committed, no conviction by jury of my peers, just pure tyranny! He used it like a baseball bat to bash me around with!

    It makes no sense until you put in that dad was a Freemason and I am not.

  6. Maybe Culleton can give me some advice…I was on a train early one evening, I had been up early, I wasn’t used to it at the time, it is really boring and I fell asleep and missed my station. I was woken by those train guards (Victoria), before the PSO’s (fake cops, protective service officers), shaken awake too, I thought I was being assaulted and almost reacted violently. I think it was excessive to wake me up like that. I nearly belted him and they all knew it.

    I had a backpack with me. They asked me what was in it. I said I am a carpenter, I have a ‘caulking gun’. They acted strangely after that. Called my Brother-in law at Metrol, yeah really, but they hadn’t told him my name yet. They told him I had a ‘gun’. So he did his job and rang the police, to meet us at the next station.

    The train guards, as I was leaving the train, threw me into the platform like I bloody deserved it, I lost my new casual job I started that day, I needed the rest of the week off after that. One of them decided to put his hand down my pants, looking for drugs! Sexually assaulted too now!

    20 coppers show up, well it certainly seemed like it. I explained to them these idiots don’t know what a caulking gun is, I am carpenter, now you are accusing of saying I had a gun! I got really angry, I am in hand cuffs and they are taking me away to police station probably 20 mins away, a lot further than the one just 30 sec walk up the road! Kidnapping! False Imprisonment! I hadn’t done anything wrong! I was not drunk! They locked me up for 4 hours!

    My brother-in-law found out who I was, that it was a caulking gun and due to his position, boss of the floor at Metrol (Metro and V-line control room) and what they got him to do to me because of their ignorance, they all got sacked.

    I should have sued the lot of them, the railways and the Vicpol, my brother in law was protected by their ignorance and that he is an employee.

    Should hear the one about the intervention order! Freemason did it to me! My Dad. Cops/courts are rigged for them.

    The police that took the word of the banks or finance companies without due diligence then removing people from properties should be criminally investigated and charged. Period.

    We seen the true colours of Australian police during covid.

    The police are not protecting the public anymore, nore are they encouraged too.

    The standards to become a police officer is extremely worrying and should be of up most concern to all Australians. People with high IQs are being denied application to the police, military, fire and ambulance services.

  8. This is what happens when corrupt governments outsource the land titles registry to an equally corrupt corporation in league with even more corrupt banks and turn all land titles into a digital registry negating and undermining the traditional parchment/paper land titles.
    This is a very good reason why going digital is such a bad idea.
    It might be quicker but it’s much more open to abuse.
