Landgate, a private corporation has been handed all of Western Australia’s land titles to manage and in spite of being warned about a flood of upcoming fraud on title claims CEO Trish Scully wrote that land owners should not have rights that override those with an interest in the property.

Former WA Senator Rod Culleton has been spearheading a national campaign for land owners to have their properties returned after it was found the titles office could not lawfully transfer a title to a mortgagee such as a bank.

Culleton was critical of the standover attitude of Ms Scully which he said was typical of the tactics of government and corporate alliances which run roughshod over people every day.

“Governments are in place to protect their citizens from the corrupt banks and corporations and the recent unprecedented fine for ANZ for dodgy businesss practices should be a wake up call for all of them,” Mr Culleton said.

“Customers who borrow from banks do have rights in spite of what Trish Scully thinks.”

A Queensland property legal researcher Carolyn Thomson has prepared a draft bill for WA and the states to adopt for protection against what Culleton warns will be hundreds of claims for compensation by disaffected land owners.

Ms Thomson sent a draft bill to the Minister but he asked Landgate CEO to respond respond who claimed borrowers’ rights are overridden by lenders’. Below is a part of Scully’s letter to Carolyn Thomson.

“I understand your interest in the issues you have raised in your proposed bill.

However, this is not the proper process for the drafting and introduction of legislation

into Parliament; Parliamentary Counsel’s Office is responsible for preparing drafts of

Bills for Ministers to be introduced into Parliament in accordance with the government’s

legislative program. 

In addition, the purpose of your bill is not supported by Landgate. People who fail to

meet their obligations under mortgage agreements they chose to enter into, resulting in

exercise of a power of sale, do not, and should not have rights that override other

interests in the land. 

As such, your request and draft Bill and Explanatory Memorandum will not be

progressed or recommended by Landgate to the Minister for Planning and Lands.”

Already this year three land owners whose properties were sold by banks as mortgagee in possession have been returned to their properties due to fraudulent practices by banks, court and land title Registrars.

Rather than seeking redress through the courts, Rod Culleton is exercising legal rights directly through the statutory processes available under the Torrens System, specifically engaging the Commissioner of Titles, who holds the statutory powers of the Supreme Court in matters involving the correction of land titles and protection of the Register.

Culleton maintains that judgment creditors — purporting to act as mortgagees — have bypassed the mandatory enforcement provisions under Western Australian law, obtaining default monetary judgments and using them to take possession and sell land without proper legal authority and due process.

Culleton says there are potentially thousands of similar cases across the nation which would expose governments to billions of dollars in damages.

    I wonder if the property owner receives the $32.60 or the corporation?

  6. Ive been looking into this, the key to protecting your property is drafting your own deed transfering ownership from you as the trustee to yourself, this is quite lawful and can be seen in the conveyancing and law of property act 1884 Tasmania section 62

    The claim is that the government itself is a privatised corporation therefore Landgate would be a subsidiary. They behave as if they are above the law, referring to “the Queen of Australia” and ignoring their own laws where is suits them, and devolving all authority and responsibility they can to Swissy’s agencies such as the RBA (BIS) and UN (WHO) treaties.
    There is a[n] historic precedent when under QE1 the English were using “privateers” which were a type of pirate ship used to raid the Spanish ships but not officially English, principle later extended to East India companies, Sassoons opium etc etc bla bla.

    The banksters are playing the long game. While your house is mortgaged it trends higher in $ value, the bank interest may not even keep up with the devaluation of the $. However by lifting the total debt with total house price rises they are getting a bigger trough to stick their noses in. Over in Asia houses are still cheap ( not for sale to foreigners ) so the finance industry concentrates on cars and everything becomes a gridlock of NEW cars, while people wring their hands with anxiety about how they will pay their other bills. In both cases human competitiveness is leveraged to increase the size of the banksters’ trough. The abundance of created credit feeds into devaluation of the currency which feeds through the economy into “price inflation”, meaning only the select few can keep the wages up with the price of commodities such as houses, gold etc., everyone else gets poorer, so the banksters are getting a bigger cut of everyone’s income, and also probably able to repossess houses quicker.
    So in the long game they are getting increased hours of slavery out of individuals for their brokerage service.

After you paid the mortgage off you have to pay the bank a few hundred dollars to release the title from the mortgage and you get a crappy acknowledgement that is more like an email than a certificate. So then the government has its hooks in your title. Perhaps what you need is to remortgage it to some type of offshore blind trust so it becomes too hard for them to follow up.

  17. The Supreme Court is an Admiralty Court that is fake and as a Maritime Court, has NO JURISDICTION On LANDMASSES. If you foolishly attend it, you are submitting to their unlawful procedures and you will lose the case. Do not open and or read their paperwork or charges as they are false under original Constitutional Law.
    Only Common law Courts have jurisdiction and they obliterated them from fake government that now exists.
    Their mail has your name in CAPITOL LETTERS on it and therefore is addressed to an unlawfully registered corporation that stole your name at birth, and created your strawman account that pays for all your debts…unknown to you…and they cash in on it when you borrow money from your own account.
    You are not that capitolised name, and must refuse their charges and mail, even for traffic offences and parking fines, etc

  19. Lets go one further to remove the claim that “you borrowed the money and need to pay it back”. The bank does not lend money it uses your signature as a promissory note to create the funds. It also sells that mortgage and bundles of other in tranches via SPVs. This is not disclosed to the mortgagee. The mortgage also fails it’s legal requirement as no consideration or sum is on it. This makes the mortgage fraud In the first place and they have been paid. So all your left with is a debt account plus interest.
    They know the document is on shaky ground hence they go to supreme court to prove the debt and the courts always regardless of evidence rule in favour of bank even if the debt was sold. This way your stripped of equity and some walk some dragged away under police envolment in a civil matter= Armed robberies.

    So you never borrowed money in the first place fact. Your are actually the creditors.

    Its the biggest scam on the people all legal in the private club you the living are not in.

  24. This has been the go in queensland for a decade. PAper titles abolished. queenslanders do not own their properety. They have an “interest” in the property. the qld gov has secured loans with the digital titles. When, not if, when the Qld gov defaults that loan, queenslanders have lost their property to the lender. And what is happening in WA now is the preamble to a simmilar theft of property as in queensland.
