Referendums and plebiscites overview
Referendums
4. Section 128 of the Constitution sets out the procedure for conducting a referendum. For a referendum to succeed, it must be supported by a majority of voters in Australia, and a majority in at least four of the six states. Section 128 also requires that a referendum be conducted between two and six months after the proposed law passes the Parliament.
5. The most recent referendums were the unsuccessful 1999 republic and constitutional preamble referendums.

Due to the long period since the last referendums, and the difficulty of holding a successful referendum due to the double majority requirement, prior to any further referendum, there will need to be actions taken to educate the Australian public about the Constitution, and constitutional reform, as well as the particular proposal.

7. The main legislation supporting referendums – the Referendum (Machinery Provisions) Act 1984 – also requires modernising (with amendments currently being formulated and drafted).
8. The Referendum (Machinery Provisions) Act is administered by the Minister for Finance and the Special Minister of State. Notably, section 11 of the Act prevents the expenditure of public funds on public campaigns for or against a proposed alteration (other than via the ‘yes’ and ‘no’ pamphlets).
9. It has been common past practice to amend at least section 11 in advance of a referendum to allow for the conduct of publicly funded campaigns related to the referendum (in addition to the ‘yes’ and ‘no’ pamphlets).
10. A summary of the main legal requirements relating to the timing of a referendum are set out in Attachment B. s 47C(1) REDACTED. The indicative minimum timeframes set out in Attachment A assume that the policy work on formulating a referendum proposal has already been undertaken.
Plebiscites
11. In Australia, the term ‘plebiscite’ refers to a public vote on an issue which does not amount to a referendum for the purposes of s 128 of the Constitution and therefore a plebiscite alone is insufficient to change the Constitution. A plebiscite typically has no legal effect of itself.
12. Australia has rarely held plebiscites. In 2017 the Australian Bureau of Statistics conducted the Australian Marriage Law Postal Survey which was non binding but led to changes to the Marriage Act 1961 to enable same sex marriage. Australia has held other plebiscites, however these were in 1916 and 1917 in relation to conscription and in 1977, ‘Advance Australia Fair’ was chosen through a national plebiscite as the official national song.

The role of plebiscites
13. Depending on how it is conducted a plebiscite may require new legislation (as was proposed in the Plebiscite (Same Sex Marriage) Bill 2016). It may be possible to hold a national vote by postal survey as was done by the Australian Bureau of Statistics in 2017 in relation to same sex marriage. However, there would need to be an appropriation of money available for expenditure on the national vote.
a. The same sex marriage postal survey was held under the Census and Statistics Act 1905 as the bill authorising the vote was defeated in the Senate on two separate occasions. Wilkie v The Commonwealth; Australian Marriage Equality Ltd v Cormann [2017] HCA 40 was a
challenge to this approach, particularly the legal mechanism for funding the survey, but was unsuccessful.
14. Two national plebiscites were held in Australia on military service in 1916 and 1917. The 1916 plebiscite was conducted under the Military Service Referendum Act 1916 (the 1916 Act). The 1916 Act included provisions applying specified provisions of the Referendum (Constitution Alteration) Act 1906 1915 with modifications and providing that the Chief Electoral Officer of the Commonwealth was charged with administration of the 1916 Act. The 1916 Act contained the plebiscite question and various provisions prescribing the conduct of the election, eg, issue and
return of the writ, scrutiny of votes and form of the ballot paper. The 1917 plebiscite was conducted under the War Precautions (Military Service Referendum) Regulations 1917, which included provisions applying the Referendum (Constitution Alteration) Act 1906 1915 with modifications.
15. In May 1977, ‘Advance Australia Fair’ was chosen through a national plebiscite as the official national song. The 1977 poll was conducted by the Australian Electoral Office. An earlier poll had been conducted by the Australian Bureau of Statistics in 1974 on the national anthem.

The 1999 referendum (held November 1999) on whether Australia should become a republic was preceded by a substantial report of the Republic Advisory Committee in 1993, and then a constitutional convention in February 1998. The convention was attended by elected and appointed members, including representatives of Commonwealth, State and Territory governments, and both supporters and opponents of the Australian republican movement.
