Labor Magistrate throws out charges
Charges against the Queensland Police Commissioner for failing to provide regular tyre-spike training to her officers have been dismissed.
Katarina Carroll had been charged with two counts of failing to comply with her health and safety duties between January 1, 2012, and June 30, 2019. During this 7½-year period, 26 officers were injured on the job while deploying tyre spikes.
She sought to have the charges, brought by the Office of the Work Health and Safety Prosecutor, thrown out because she was not in the top job during the period alleged, and she claimed she couldn’t be charged with criminal offences in her position.
The charges were filed on February 1, 2021. The first charge relates to officers being put at risk by the Commissioner’s actions, while the second relates to risks to members of the public.
Magistrate Stephen Courtney handed down his decision at the Brisbane Magistrates Court on Thursday afternoon.
He said that after reading through the Work Health and Safety Act and The Police Service Administration Act, he found the police commissioner herself could not be a defendant.
“Ultimately, I am satisfied section 248 does not authorise the office of the commissioner of the police service to be named as a defendant and a complaint will be in breach of the work health and safety act,” he said.
“I am also satisfied the office of the commissioner of the police service is not otherwise a legal personality capable of being so named.”
Judge Courtney also said the particulars around practical measures of spikes were at times “inconsistent” but followed legal obligations overall.
“The particulars read together tell the commissioner what duty owed, when it failed to comply with the duty, what it did in attempting to comply with duty, what additional measures were practical … I am satisfied the particulars read as a whole satisfy those requirements,” he said. – Brisbane Times

The way they act, engagement with pushing there weight around, parking in bus stops to go into 7/11 store. They are driving a black unmarked jeep. She is marked person by the paranoia they stink of. Many offices have lost respect for the snr ranks, they feel no longer supported.

I agree with you, we need a clean-up to remove the corruption and incompetence, which is now endemic. But we no longer have Rule of Law. We have no judiciary of integrity. A dozen years ago, a Brisbane magistrate ruled she is Immune to the law. This lawlessness is not new.
But you need to appreciate the gravity of what you are saying. There is only one recourse left for the people… removing the corruption by force, which is the technical term for civil war.
That is where most Australians are stuck. The knowledge that the answer must come from each individual. This prospect terrifies them, so they are standing still like a deer in the headlights. Others are so naive they think that divine incantations will do the job for them, Others, that peaceful protest will force the psychopaths to step down in shame.

Cut a long story short the QLD police chased a young offender (from Maroochy) into the parked traffic on the road up to Mt Tamborine. What happened to calling off a chase when it becomes dangerous to civilians?….Where the Fk was the police helicopter to assist the police. Unfortunately he landed right next to my car after hitting a poor traumatised woman in line that pulled off to the left as she thought it was the Ambo’s….
I had my window down sitting in the passengers seat waiting patiently for the light to changed.
We had the criminal scum that landed I don’t know how next to me and as soon as I saw the police jump from their vehicle I told my partner to turn on the car so I could wind up my window and get the hell out of the way. Labour Magistrate Stephen is clearly ‘in the know’ as to what is coming down the pipeline. To wit he upheld the right of the top cop to basically tell the court to F(arce) off. The exact quote is: ‘in my position I can not be prosecuted for any offense’. Obviously in the Cressida Dick mould, the imperious Katrina is above the rule of mere laws.

Magistrate Stephen Courtney failed to make clear to the public the reasons for his decision.
The principle of bureaucratic accountability basically says “The buck stops here” pointing to the highest officer in the service in question. So, if officers have been injured when laying road spikes, this clearly reflects inadequate safety training OR that the practice itself is intrinsically unsafe; both of which the most senior police officer is paid to assess.
Obviously, this has not happened, so either the prosecutor targeted the wrong senior officer, or the magistrate is saying nobody is responsible.
Justice must be seen to be done and this magistrate failed also in this regard.
Australia needs a nationwide clean-up of incompetent judges and magistrates. Followed up by a review of senior police, especially in Queensland.

Also there’s not a COURT-OF-JUSTICE anywhere in the country they’re all unidroit tribunals, appointed by,and administered by the criminal government, hence we have “criminal law”.
